Summary
1. On 29 August 2012, the Tier 4 sponsor licence of London Metropolitan University (London Met) was revoked due to non-compliance with its sponsorship duties. This decision was not taken lightly and made following a period of suspension and audits of the University’s student records which identified a number of serious breaches of their sponsor duties.
2. The revocation of London Met’s licence means that non-EU students will no longer be permitted to study at London Met. However, London Met students with a current valid visa do not have to do anything immediately.
3. BIS are convening a task force to be lead by HEFCE and UUK, which will include UKBA and the NUS, to work with London Met to support affected students and enable genuine students to find another institution at which they can continue their studies in the UK. The task force will start work immediately. Affected students can also check for updates on the UK Border Agency website.
4. The Government recognises the important contribution that international students make to the UK, and is committed to keeping our education system one of the best in the world. We welcome all genuine and legitimate students, and there is no cap on the number of international students who can be accepted to study in the UK. We fully appreciate the economic benefits and wider enrichment students bring to the UK. We want to encourage students to come and study at our world-class academic institutions.
Detail
Background
5. The UK Border Agency’s most recent audit of this university revealed issues with 61% of the files randomly sampled. These are serious and systematic failings.
6. It is important that UKBA are clear, these are problems with one university and we have taken the right course of action. Our message is still that British universities are among the best in the world – and Britain will remain a top class destination for international students.
7. The London Met has about 4,200 non-EU overseas students studying at the university. We understand that genuine international students at London Met may be concerned. London Met students with a current valid visa do not have to do anything immediately. BIS are convening a task force to be lead by HEFCE and UUK, which will include UKBA and the NUS, to work with London Met to support affected students and enable genuine students find another institution at which they can continue their studies in the UK. The task force will start work immediately.
8. Further information for affected students will be published as it becomes available on the UK Border Agency website. Some further Q&A is also provided below.
9. As well as helping genuine students, the UK Border Agency will take action against those abusing the visa system. Over the coming weeks and months we will be contacting them and undertaking enforcement action where necessary.
Legal challenge
6. Although there is no right of appeal, the decision is open to judicial review. We will keep you informed of any developments.
Lines to take
UK Border Agency Spokesperson:
“London Metropolitan University’s (LMU) licence to sponsor non-EU students has been revoked after it failed to address serious and systemic failings that were identified by the UK Border Agency six months ago.
“We have been working with them since then, however the latest audit revealed issues with 61 per cent of files randomly sampled. Allowing LMU to continue to sponsor and teach international students was not an option.
“These are problems with one university, not the whole sector. British universities are among the best in the world – and Britain remains a top class destination for top class international students.
“We are doing everything possible, working with Universities UK, to assist genuine students that have been affected.”
David Willetts, Minister for Universities and Science said: "It is important that genuine students who are affected through no fault of their own are offered prompt advice and help, including, if necessary, with finding other institutions at which to finish their studies" he said. "We are tonight asking HEFCE and UUK to lead a task force, which will include UKBA and the NUS, to work with London Metropolitan University to support affected students and enable them to continue their studies in the UK. The task force will start work immediately.
Britain remained a top class destination for international students, and welcomed them.
How many students will it affect?
The London Met has about 4,200 non-EU overseas students studying at the university
What will they have to do?
The revocation of London Met’s licence means that non-EU students will no longer be permitted to study at London Met. However, London Met students with a current valid visa do not have to do anything immediately. We will be working closely with Universities UK to offer support to those appropriately qualified to find another institution at which they can continue their studies. They should check for updates on the UK Border Agency website.
Do they have to leave?
Our aim is that genuine students with legitimate leave to be studying at London Met should not have to leave the country, but should be able to complete their studies at some other institution. No student is required to leave unless they have been informed by the UK Border Agency that their leave has been curtailed – in which case they would either need to find a new institution or leave the country within 60 days. We will be working closely with the taskforce set up by BIS to offer support to students who meet the appropriate requirements to find another institution at which they can continue their studies.
What happens if a student is on holiday – can they come back in?
If a student studying at London Metropolitan University has current valid leave to study there, he or she can return from holiday.
